The more I read the Supreme Court birthright citizenship ruling, the less I buy the happy talk around it.

Trump was right to force the issue. Birthright citizenship has been abused for years, and somebody finally had to put the 14th Amendment fight in front of the courts instead of letting Washington pretend there is nothing to discuss.

But Amy Coney Barrett did not give us the big win people are pretending she did. The Court narrowed universal injunctions, sure, but it dodged the actual birthright citizenship question. That leaves the whole country stuck in more lawsuits, more procedural games, and more judges kicking the can instead of saying plainly what the Constitution means.

If the Court refuses to settle it straight, then fixing birthright citizenship may come down to Congress, the states, or even an amendment. And everybody knows how hard that road is.

So no, I am not clapping for Barrett on this one. Trump put the fight on the table. The Court should have had the spine to deal with it.

What are you talking about? it was settled Amy Coney Bryant screwed this country. That means all those Chinese people that came over here and gave birth and went back to China now have a way to mail in ballots to vote. Now the only way to circumvent that ruling is to have legislation drawn up which is not going to be easy at all to pass.

I think Amy Coney Bryant betrayed this country.

It may suck, but SCOTUS has ruled those born in the USA to parents subject to the laws of the USA are citizens. A future session of SCOTUS may overrule this. Or a Constitutional Amendment may get ratified to remove this aspect of the 14th. Until one of those happen, Birthright citizenship remains.
